GameFlood Copyright Policy

GameFlood was built from the ground up as the place to find and publish the best new playable content for your favorite games. It's not a peer to peer network which allows users to anonymously trade other people's work, or a web site that attracts viewers by enabling trafficking in pirated material. GameFlood creates the market where copyright holders of digital media can use Internet based distribution similar to the peer to peer model and profit from it.

Because our marketplace is based on the remuneration of copyright holders, we respect all copyright laws in the United States and internationally. Members submitting content to GameFlood have warranted that they are the copyright holders, or authorized agents of the copyright holders, for all content submitted. Violations of this warranty will not be tolerated by GameFlood, and typically will result in the permanent expulsion of the person who submitted the work. In some cases, a second chance for the seller to publish will be granted, at GameFlood’s discretion, based on the character of the infringement. In all cases, repeat infringers will have their accounts terminated from the system.

Where any product has a disputed copyright, GameFlood will withhold any revenue due to the seller for sales of the product. Such revenue will be remitted to the legitimate copyright owner once that is determined.

If you are a copyright owner, or the authorized representative of a copyright owner, you may report an alleged infringement by contacting GameFlood's Designated Copyright Agent (identified below) with a written communication that includes substantially the following:

    A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

    Identification of the material that is claimed to be infringing or the subject of infringing activity, and that is to be removed. GameFlood also needs information reasonably sufficient to locate the material, but in no event less than: product name, submitting member name, file size, and date submitted.

    Information reasonably sufficient to permit GameFlood to contact you, such as an address, telephone number, and, if available, an e-mail address at which you may be contacted.

    A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copy-right owner, its agent, or the law.

    A statement that the information in the notification is accurate, under penalty of perjury, and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

All claims of copyright infringement shall be delivered to the Designated Copyright Agent of GameFlood:
